This digital agreement is executed in conformity with the provisions of the Information Technology Act, 2000, the rules framed thereunder, and the Indian Contract Act, 1872. If you do not agree with any provision of these Terms, you must immediately discontinue your use of NYAYI.

NYAYI is an independent technology and legal literacy initiative founded by Farhan Khan and Kamran Sheikh. Its sole objective is to democratize legal comprehension across India by providing organized summaries of statutory provisions, procedural outlines, terminology explainers, and AI-assisted legal research.

NYAYI is NOT a law firm and does NOT practice law. Nothing on this platform establishes an advocate-client relationship, a fiduciary engagement, or a solicitation for legal employment under the Bar Council of India Rules. Communications with NYAYI are not protected by advocate-client statutory privilege under Section 126 of the Indian Evidence Act, 1872 (or Section 132 of the Bharatiya Sakshya Adhiniyam, 2023).

By accessing this platform, you affirm that you are at least 18 years of age and are legally competent to enter into a binding contract under Section 11 of the Indian Contract Act, 1872. If you are accessing this website on behalf of a company, corporate body, or institution, you represent and warrant that you possess full legal authority to bind that entity to these Terms.

You agree to use NYAYI exclusively for lawful, non-commercial, educational, and research purposes. You warrant that you will not:

• Use the platform to draft deceptive, fraudulent, defamatory, or unlawful documents intended to deceive any judicial authority or private party.
• Misrepresent AI-generated informational summaries as formal legal opinions issued by a licensed advocate.
• Interfere with or disrupt the security, integrity, or operational performance of the website or its underlying server infrastructure.
• Submit malicious scripts, computer viruses, Trojan horses, or harmful code designed to impair site availability.

NYAYI integrates computational linguistic models and automated search engines to assist citizens in discovering relevant statutory codes (such as BNS 2023, BNSS 2023, BSA 2023, and IPC equivalents). You acknowledge that:

• AI models operate on probabilistic pattern recognition and may generate inaccurate, incomplete, or outdated correlations.
• Automated responses cannot consider the nuanced facts, local judicial practice, evidence rules, or procedural strategies of individual court cases.
• You bear sole and absolute responsibility for verifying any AI-suggested statutory references with the official gazette before taking any action.

All original website architecture, design layouts, visual styles, UI components, codebases, custom explanations, and editorial compilations on NYAYI are the exclusive intellectual property of NYAYI and its creator Farhan Khan, protected under the Copyright Act, 1957 and relevant international conventions.

Primary statutory texts of Indian enactments (e.g., Acts of Parliament, state regulations, and official notifications) are public domain records under Section 52(1)(q) of the Copyright Act, 1957. You are permitted to cite or reproduce statutory texts, provided that proprietary platform branding, original guides, UI assets, and dictionary syntheses are not mirrored, duplicated, or republished without written consent.

To preserve fair bandwidth for all Indian citizens and protect our curated database, the following activities are strictly prohibited without prior written authorization from NYAYI:

• Employing automated spiders, web scrapers, crawlers, or extraction algorithms to harvest dictionary terms, law cards, or guides in bulk.
• Bypassing or attempting to circumvent rate-limiting mechanisms, robot exclusions, or authentication controls.
• Framing, embedding, or white-labeling NYAYI pages within any third-party commercial legal portal or mobile application without attribution.

NYAYI frequently provides outbound hyperlinks to government databases, court portals (e.g., e-Courts, Supreme Court of India, India Code, NALSA), and official police helplines. These links are furnished solely for citizen convenience. NYAYI exercises no editorial or operational control over third-party domains and assumes no responsibility for their content, uptime, security, or data handling practices.

THE NYAYI PLATFORM AND ALL ASSOCIATED CONTENT, ALGORITHMS, CALCULATORS, AND PROCEDURAL GUIDES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE INDIAN LAW, NYAYI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR LEGAL PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.

UNDER NO CIRCUMSTANCES SHALL NYAYI, ITS FOUNDERS (FARHAN KHAN & KAMRAN SHEIKH), CONTRIBUTORS, AFFILIATES, OR TECHNOLOGY PARTNERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER—INCLUDING BUT NOT LIMITED TO LOSS OF LEGAL RIGHTS, COURT EXPENSES, FINES, ADVERSE JUDGMENTS, LOSS OF PROFITS, OR BUSINESS INTERRUPTION—ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THIS WEBSITE OR ITS INFORMATIONAL CONTENT.

You agree to defend, indemnify, and hold harmless NYAYI, its founders, editors, and developers against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your violation of these Terms of Use; (b) your misuse of information obtained from NYAYI; or (c) your infringement of any intellectual property or privacy rights of any third party.

These Terms of Use shall be governed by and construed in accordance with the substantive laws of the Republic of India, without regard to its conflict of law principles.

Any legal action, suit, or proceeding arising out of or relating to these Terms or the NYAYI platform shall be instituted exclusively in the competent civil courts situated at New Delhi, India. Both parties hereby consent to the exclusive territorial and personal jurisdiction of such courts.
